XXXX Summer Bright Lager 'Mystery Beach' Promotion Terms & Conditions

1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to Australian residents only who are 18 years and over. Employees and their immediate families of the Promoter and its agencies are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. To enter, go to the XXXX Summer Bright Lager website www.xxxxsummer.com.au during the Promotional Period and follow the link to the entry section. Follow the instructions given there to submit your 'favourite' Australian beach location along with a picture of that location and the reason for your choice (in 25 words or less). Share your entry with your friends via the Facebook 'share' function. Friends will then have the option to 'like' your Australian beach submission either by clicking the 'like' button below your entry on the XXXX website, or by 'liking' the entry after it has been shared via Facebook. The major prize winner will be the person with the most 'likes' against their favourite Australian beach submission.

   Limit of 1 submission per person during the Promotional Period.

4. The promotion commences at 12.00 (midday) EST on 05/05/2011 and closes at 14.00 EST on 02/08/2011 ("Promotional Period").
5. Major Prize - There will be 1 major prize to be won in the promotion. The major prize winner will be the person whose individual submission has the highest number of 'likes'. In the event that there is a tie between 'favourite Beach' locations, the Promoter will make the final decision based on the individual submissions. The Promoters decision is final.
6. Minor Prize - The first 250 consumers to submit their 'Mystery Beach' location will receive a pair of XXXX Summer Bright Lager Sunglasses [RRP$20.00]. Minor prize winners will be notified via return email within two business days of submission. The return email correspondence will include information on how they will receive their minor prize.
7. The major prize winner will be determined at 16.30 EST on 02/08/2011 at Holler, Suite 2, Level 2, 2-12 Foveaux Street, Surry Hills NSW 2010. The winner will be notified via email within 2 business days and advised of their win. The major prize winner will also be notified by email within 48 hours of the major prize determination. The name of the major prize winner (and the address (suburb) of any winner residing in SA) will be published in The Australian newspaper on 01/09/2011

8. The major prize winner will have the ability to choose one (1) of the following major prizes:

   1. A weekend trip for the winner and an adult friend for two (2) nights which comprises:

      • Economy class airfares for 2 adults from winner's nearest Australian capital city to the beach destination which received the most total 'likes' during the Promotional Period (the "Winning Beach Location"). For the avoidance of doubt, the Winning Beach Location may be a different beach location to the major prize winner's favourite beach location;
      • All airline & airport taxes;
      • Return bus airport transfers between airport and Winning Beach Location;
      • 2 nights in 4 star accommodation in vicinity to the Winning Beach Location in one twin share hotel room, including breakfast daily. If no such accommodation is available in the vicinity of the Winning Beach Location, the Promoter may choose alternative accommodation. If the major prize winner does not accept the alternative accommodation chosen by the Promoter, s/he may elect to take the second prize option in place of the first prize option; and
      • Meal costs to the total value of $400.00 (In the form of a pre loaded debit card (which may be used wherever EFTPOS is available) – excluding alcohol and at winners choice of locations).

      All other ancillary costs, including but not limited to taxes, meals, drinks, transfers, insurance, activities, incidentals and any and all other expenses (unless specified above) are the responsibility of the winner.

   2. a $5,000 Debit Card available for use wherever EFTPOS is available.
9. Total maximum RRP value of the major prize is $5,000.00. Total RRP value of all minor prizes is $5,000. Total RRP value of all prizes is $10,000.
10. The major prize is subject to select seat class availability with airline and specific room category availability with accommodation provider. Flights and accommodation are also subject to the participating airline's and accommodation provider's booking and reservations policies, with the airline and accommodation providers reserving the right to restrict bookings at any time. The winner and guests may be required to provide a credit card imprint at check-in that will be used to charge for incidentals such as optional tours and/or will be used as a bond in case of damage to the property. All such costs and damage are the sole responsibility of the major prize winner and guest.
11. The major prize winner and guest must both be aged 18 years or over. The major prize must be booked within 90 days of the draw date (or unclaimed prize draw date) and at least 60 days prior to travel. All bookings will be made by the Promoter on the major prize winner's behalf. All travel must be completed by 09/08/2012. All passengers must travel together on the same flights and stay at the same property at the destination. The major prize is a single event holiday and cannot be separated into different holiday vacations. The winner will be required to sign a prize acceptance form to accept the prize. Suppliers / airlines to be chosen at Promoter's discretion. The major prize cannot be taken during peak holiday times, which are 20th June to 20th July, 25th September to 10th October, 15th December to 15th January and Easter long weekend, or school holidays. Availability cannot be guaranteed during other special event periods.
12. It is a condition of accepting the prize that the major prize winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier's requirements. Once booking is confirmed, changes will incur a fee of $150 per person (including GST) plus supplier charges, all of which are to be met by the winner. Changes within 7 days of travel are not possible and the prize will be forfeited in its entirety. If travel is not completed by 09/08/2012 it will be forfeited. If the prize is forfeited for any reason no prize substitute will be offered, and the prize will not be re-offered.
13. If, despite reasonable efforts, the Promoter has not been able to contact the initial major prize winner on or before 01/12/2011, and the major prize winner has not otherwise claimed the major prize by this date, the Promoter will award the major prize to the entrant whose individual entry had the second highest number of 'likes' during the Promotional Period. This determination will be made at 16.30 EST on 01/12/2011 at Holler, Suite 2, Level 2, 2-12 Foveaux Street, Surry Hills NSW 2010. The Promoter will notify the successful entrant of the prize by email within 48 hours of the determination. The name (and address (suburb) if the winner resides in SA) of the unclaimed major prize winner will be published in The Australian newspaper on 5/12/2011.
14. If necessary, a second chance draw will be held at 16.00 EST on 01/12/2011 at Holler, Suite 2, Level 2, 2-12 Foveaux Street, Surry Hills NSW 2010 to distribute any unclaimed minor prizes. All entrants in the Promotion, except previous minor prize winners, will be included in this second chance draw. Unclaimed minor prize winners will be notified by email within 48 hours of the draw. The email notification will include information on how they will receive their minor prize.
15. Prizes are not transferable and are not redeemable for cash. The Promoter's decision is final and binding - no correspondence will be entered into.
16. In the event that any or part of any prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.
17. The Promoter reserves the right to request verification of the age, identity and residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in interfering, manipulating or tampering with the conduct of this promotion.
18. The prize winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded or limited by the Promoter. These rights include a statutory guarantee that any services provided by the Promoter will be rendered with due care and skill. These Conditions of Entry do not, and do not intend to, exclude or limit those statutory rights in any way.
19. The prizes are subject to the terms and conditions of the transport, accommodation and other prize suppliers. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner or their guests as a result of the conduct of the transport, accommodation and other prize suppliers, or otherwise as a result of the winner and their guests accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter, or which otherwise cannot be excluded by law, including as referred to in condition 19 above.
20. Before the prizes are awarded, the winner and any person sharing the prize with the winner may be required to sign an agreement to release the Promoter from and indemnify the Promoter against any liability arising from the use of or participation in the prize.
21. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
22. Entrants confirm and promise that their submission (including their profile, photographs and written submission) is original and does not infringe the intellectual property rights of any third party. Entrants understand and agree that the Promoter may remove any content considered to infringe third party intellectual property rights. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use and modify their entry or any part of it for the purposes of the Promoter's business without the payment of any further fee or compensation. The entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
24. Entrants agree that they will not upload any photographs showing persons consuming alcohol on a beach, photographs which may otherwise be considered to promote the irresponsible consumption of alcohol, or photographs which are otherwise unlawful, and agree that the Promoter may remove any photograph which does not comply with this requirement.
25. This promotion is not sponsored, endorsed, or administered through, or conducted in association with, Facebook.
26. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. 1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to Australian residents only who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and outlets associated with this promotion are ineligible to enter. 3. To enter, purchase any specially marked 330ml bottle six pack of XXXX Summer Bright Lager or any specially marked carton containing specially marked 330ml bottle six packs of XXXX Summer Bright Lager from a participating outlet during the Promotional Period.

   Find a unique code inside the specially marked 6 pack and use the unique code to enter by SMS or WEB during the Promotional Period as follows:

   1. SMS: To enter by SMS, send the unique code along with your full name and state to 0421 267 267 during the Promotional Period. Example Entry: Uniquecode [space] FirstName [space] LastName [space] Postcode (in Full Capitals). SMS call cost is 55 cents including GST. Each entry must be sent in a separate SMS. 5. There will be 8 minor prizes to be won each day during the Promotional Period.     Each Major Prize is valued up to a maximum RRP of $50,000 (depending on point of departure). All other ancillary costs, including but not limited to taxes, fuel, meals (unless specified), drinks (unless specified), transfers (unless specified), activities (unless specified), incidentals and any and all other expenses are the responsibility of the winner. There are 3 major prizes to be won.

    Where winner or one of winner's guests is aged 21 years or over and holds a valid full Australian C class drivers licence, prize includes:

    • 6 days car hire, pick up Brisbane airport - drop off Coffs Harbour Airport, includes unlimited KMs, one way rental;
    • 4 days car hire pick and drop off Hobart airport (winners will drive to and from Mayfield Bay from Hobart);
    • 7 days car hire, pick up Melbourne airport - drop off Adelaide Airport.

    Car hire will include unlimited kms. The hire vehicle in all stated locations will be a four door, five seat, automatic vehicle.
